【摘要】:MandateM/366oftheEuropeanCommissiontoCEN,titled:"DEVELOPMENTOFHORIZONTALSTANDARDISEDASSESSMENTMETHODSFORHARMONISEDAPPROACHESRELATINGTODANGEROUSSUBSTANCESUNDERTHECONSTRUCTIONPRODUCTSDIRECTIVE(CPD),emissiontoindoorair,soil,surfacewaterandgroundwater",whichcreatedCEN/TC351,requiredanumberoftechnicalreports(TRs)toassistintheprocessofstandardisation.ThefirstoftheseTRswastoestablishtheextentoforpresenceoftechnicalbarrierstotraderesultingfromrequirementsunderEssentialRequirement3(ER3),asperceivedorexperiencedbymanufacturersofconstructionproducts,demandedbyEUMemberStates.SincetheCPD(CouncilDirective89/106/EECofDecember21,1988concerningconstructionproducts)isaimingtoliftbarrierstotrade,therewouldbenopoint,intheory,indevelopingstandardsinCEN/TC351forthepurposeofER3ifnotechnicalbarrierstotradeexist.However,the"Grounds"forthisMandate,givenbytheCommission,state:'...thisstandardisationmandatereferstoproductsforwhichthetwofollowingconditionsarefulfilled:a)theproductsareorrisktobesubjecttotechnicalbarrierstotradearisingfromregulateddangeroussubstances;b)thecharacteristicsoftheproductsregardingregulateddangeroussubstancesinfluencethesatisfactionbytheconstructionworks,inwhichtheyaretobeincorporatedinapermanentmanner,oftheessentialrequirementsaslaiddowninarticle3oftheCPDandsetoutintermsofobjectiveswithregardtohygiene,healthandtheenvironment,inAnnex1oftheCPD.Theseworksaresubjecttolegislative,regulatoryoradministrativeregulationsofMemberStatescoveringsuchessentialrequirementsspecificallyinthefieldofdangeroussubstances'.lFurther,inClause7ofthe"ExecutionoftheMandate"referringtotheworkprogrammeofCEN,itstates:'It[theworkprogramme]shallidentifyandcoverallproductsorproductfamiliesforwhichthethreefollowingconditionsarefulfilled:--Europeanornationalregulationsarelimitingorbanningtheemissionorcontent(seeIV.8)ofdangeroussubstances;--Existingorpotentialbarrierstotradehavebeenidentified;--Measurement/testmethodsforthesespecifiedregulateddangeroussubstanceshavealreadybeendevelopedandareusedonanationalorEUlevel.Consideringpoint(a)inthe"Grounds"fortheMandateitisstatedthatproducts"atrisk"fromtechnicalbarrierstotradeareequallyimportanttoexistingbarrierstotrade,andalsointheaboveClause7,ExecutionoftheMandate,theseconddashrefersto"potentialbarriers"aswellasestablishedbarriers.Thismakesthescopeoftheworkwiderthansimplyidentifyingexistingtechnicalbarriers.TheMandatealsospecificallyrefersto'technical'barrierstotrade,andCENisespeciallyaskedtoconsiderintheWorkPackagethefollowingTR:"WorkPackage1:technicalreports:proceduresfortestingandtestingschemes
